Regulated outsourcing

ftl’s experts specialise in providing legal services to banks and payment institutions in the outsourcing of regulated activities – in particular the outsourcing of banking, payment and other financial services, as well as support for business entities offering their services to the banking sector. Our team has been responsible for the implementation of dozens of unique projects in the outsourcing of innovative financial products, including the outsourcing of cloud services and new technologies. We continuously support both supervised entities and insourcers.

Advisory services

The ftl team provides legal support at the stages of contract drafting and internal procedures through to audits.

Our experts provide comprehensive support both at the stage of preparing outsourcing contracts and their negotiation. The ftl team also offers advice to our clients on the preparation of the supporting documentation, such as descriptions of technical and organisational solutions, BCPs, SLAs or exit plans.

In cooperation with clients, ftl experts create outsourcing procedures and internal documentation for supervised entities, ensuring full compliance with Polish and EU laws and regulations, but also matching individual client needs. The ftl team also advises in the process of internal implementation of procedures within an organisation, by conducting workshops and training for legal and compliance departments of supervised entities.

ftl experts also conduct compliance audits of supervised entities’ management of outsourcing processes with relevant laws and regulations. The ftl team offers assistance with the creation of assessments and post-audit reports with recommendations for possible changes.

Training

In view of the increasing use of outsourcing solutions in practice, ftl experts share their experience and knowledge of outsourcing by conducting training courses tailored to the individual needs of clients. To date, members of our team have presented their expert opinions within, amongst others, the framework of the Digital Banking Academy.
